MahaRERA Dismisses Complaint Against Lodha in Construction Dispute

A resident of Lodha Dioro, within the New Cuffe Parade project, lodged a complaint against Macrotech Developers (Lodha) regarding construction on open space without the required consent from homebuyers.

  • Allegation: The complainant, who purchased a flat in Lodha Dioro, claimed that construction on the open space commenced without proper consent. They feared this might obstruct views and diminish property value.
  • Developer’s Response: Lodha clarified they had a separate RERA registration for new construction and had obtained necessary permissions. They emphasized that construction aligned with the sales agreement, which allowed phased construction without requiring consent for ongoing or new construction.
  • RERA Clarification: MahaRERA stated that the complaint lacked evidence of RERA violations by the developer. The chairman highlighted that RERA doesn’t oversee construction beyond registered project boundaries. Therefore, alleged building regulation violations should be addressed by the local planning authority.

MahaRERA dismissed the complaint, emphasizing that Section 14(2) of the RERA Act doesn’t mandate consent from allottees for construction extending beyond the initially demarcated project area. The order suggested addressing alleged building regulation violations through the local planning authority.
