Concerns Arise Over Sale Deeds Without Certificates

Many homebuyers are eager to quickly register their sale deeds with the sub-registrar, often overlooking the need for certain essential documents. They prioritize registration to take possession of their flats promptly, but this can lead to future complications if vital certificates are missing.

The builder must provide the occupancy certificate and khata certificate to the sub-registrar during the sale deed registration. Without the khata certificate, buyers may face issues as the land might still be listed under the original owner’s name.

This confusion arises because the land records are not always transferred to the municipal corporation after the land conversion process. It is the sub-registrar’s duty to ensure that the flat has both certificates and is on urban land.

However, some sub-registrars fail to check all necessary documents properly, possibly influenced by intermediaries in their offices.

Recently, the District Registrar of Basavanagudi asked the sub-registrar of Banashankari to explain a complaint about registering sale deeds without proper certificates.

Obtaining an occupancy certificate is crucial for buyers to avoid legal issues and ensure the property’s legitimacy. The khata certificate contains important details about the property.

Dhananjaya Padmanabhachar, from the Karnataka Home Buyers’ Forum, emphasized the importance of these certificates before registering a sale deed. He urged officials to follow the law and protect buyers’ rights.

Commander Surendra, a retired Naval veteran, highlighted the coordination issues between local bodies and the municipal corporation in transferring land records. He explained the process of converting agricultural land to urban land and stressed the importance of timely record transfer.
