HRERA Fines Countrywide Promoters for Misleading Advertisement

    The Gurugram branch of the Haryana real estate regulatory authority (HRERA) has fined Countrywide Promoters Private Limited Rs 50 Lakh for publishing a misleading advertisement about its project Green Oaks in a newspaper. The authority noticed the advertisement in an English daily on March 2 and sent a warning to the promoter.

    According to officials, the authority found that the promoter did not provide proper details in the advertisement, which is required by law under Section 11(2) and 13(1) of the Real Estate (Regulation and Development) Act 2016. This is considered a punishable offense under Section 61 of the Act.

    The advertisement featured a photo of a garden/park (Garden of Dreams) on one page and a picture of a club on the other page, which is not part of the project. Other parts of the advertisement listed facilities that are not part of the project, such as a squash court, club house, covered pool, spa, outdoor library, sculptural rocks, and coffee lounge. This was deemed misleading by the authority.

    Countrywide Promoters Private Limited is developing an affordable plotted colony, Green Oaks, in Sector 70-A, Gurugram, under the Deen Dayal Jan Awas Yojna Affordable Plotted Housing Policy 2016. The project obtained RERA registration in 2021.

    The promoter’s misleading advertisement showed enticing images of facilities not actually present in the project, violating Section 7(1)(A)(i) of the Act. Additionally, no details or visuals of the project’s layout or site plan were provided to help potential investors make informed decisions.

    Furthermore, HRERA noted that the promoter failed to update the registration details according to the revised layout plan.

    The project was launched in 2021, and the layout plan was revised in 2023.
